1. Agreement to These Terms

These Terms of Service ("Terms") govern your access to and use of the Damson Kitchen mobile application, website, and related services (collectively, the "Service") provided by an independent individual developer based in the United Kingdom, trading as Damson Kitchen ("Damson Kitchen", "we", "us", or "our").

By downloading, installing, or otherwise accessing the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

If you are using the Service on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms.

2. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this requirement. If you are under 18 (or the age of majority in your jurisdiction), you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

The Service is intended for personal, non-commercial use. It is offered in English and is available wherever the app store distributes it. We make no representation that the Service is appropriate for any particular location, and you are responsible for complying with any local laws that apply to you.

3. Your Device, Your Data

Damson Kitchen does not use accounts. There is no sign-up, no login, and no server-side profile of any kind. All of your recipes, collections, notes, and photos are stored exclusively in local storage on your own device.

Because your content never leaves your device except when you choose to create an Export file, we have no ability to recover your recipes if your device is lost, damaged, reset, or if you uninstall the app without first backing up. You are solely responsible for using the app's built-in Export feature to create your own backups and for keeping the resulting file somewhere safe.

4. The Service

Damson Kitchen is a personal recipe-collection application that allows you to save, organize, and cook from your own recipes. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice, though we will endeavor to give reasonable notice of significant changes. We shall not be liable to you or any third party for any such modification, suspension, or discontinuation.

5. User Content

5.1 Your Content Is Yours

You retain full ownership of all recipes, notes, photos, collections, and other content you create or upload to the Service ("User Content").

5.2 License to Damson Kitchen

Because your User Content is stored solely on your own device, Damson Kitchen does not host, store, or otherwise have access to it in the ordinary course of using the app. The only exception is the optional Export feature: if you choose to generate an Export file, you are creating and transmitting that file yourself, via a destination you select — Damson Kitchen does not receive, host, or process it. We do not use your recipes for marketing or share them with anyone.

5.3 Your Responsibilities

You are solely responsible for your User Content. You represent and warrant that:

• You own or have the necessary rights, licenses, and permissions to submit the content.
• Your content does not infringe any third-party intellectual property rights, including recipe content scraped from third-party websites in violation of those sites' terms.
• Your content does not contain material that is unlawful, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable.

5.4 Content Removal

Because your recipes and other User Content live only on your own device, we have no ability to access or remove them — that's entirely under your control within the app. This section applies only to content you submit directly to us, such as in support correspondence: we reserve the right (but have no obligation) to disregard or delete such content if it violates these Terms or applicable law.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations in your country.
• Attempt to gain unauthorized access to any part of the Service or Damson Kitchen's systems or networks.
• Scrape, crawl, or otherwise extract data from the Service through automated means without our prior written consent.
• Reverse-engineer, decompile, or disassemble any part of the Service.
• Use the Service to transmit spam, malware, or any other malicious code.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• Interfere with or disrupt the integrity or performance of the Service or the data contained therein.
• Use the Service in any manner that could damage, disable, or overburden our infrastructure.

7. Intellectual Property

7.1 Damson Kitchen's Property

The Service and its original content (excluding User Content), features, functionality, design, trademarks, logos, and software are and remain the exclusive property of Damson Kitchen and its licensors. Nothing in these Terms transfers any intellectual property rights to you.

7.2 Feedback

If you submit suggestions, ideas, or feedback about the Service ("Feedback"), you grant us a perpetual, irrevocable, royalty-free license to use and incorporate that Feedback into the Service without any obligation to you.

7.3 Third-Party Content

Recipes, images, and other content sourced from third-party websites remain the intellectual property of their respective owners. Damson Kitchen does not claim any rights over third-party content imported into the Service.

When you import a recipe from an external URL, Damson Kitchen stores only the text content and the source URL — it does not copy or store the source site's photo. The source URL is displayed alongside the recipe so the original material can be identified and accessed directly. Imported recipes are stored only on your device, like everything else in the app.

You are solely responsible for ensuring that your use of third-party content complies with the terms of the originating site and applicable copyright law. Because imported content is stored only on your own device, we have no ability to remove it from an individual user's device. 8. Third-Party Services and Links

The Service may contain links to or integrations with third-party websites or services (for example, sites you import recipes from). These are not under our control and we are not responsible for their content, privacy practices, or terms. We encourage you to review the terms and privacy policies of any third-party services you access.

9. Fees and Payment

The core Service is currently provided free of charge. We may in the future introduce paid features or subscription tiers. If we do, we will provide clear notice of applicable fees and obtain your consent before charging you. Any paid features will be subject to additional terms presented at the point of purchase.

10. Termination

10.1 By You

There is no account to delete. You may stop using the Service at any time by uninstalling the app, which removes all locally stored recipes, collections, notes, and photos from your device. If you'd like to keep a copy of your recipes first, use the app's Export feature (Settings > Data & Backup) before uninstalling.

10.2 By Us

Because the Service runs entirely on your device, "terminating your access" mainly means we may stop supporting or updating the app, or discontinue the Service altogether, at any time and with or without notice, in the event of a violation of these Terms or otherwise. Doing so does not affect recipes already stored locally on your device, though you may lose access to features like recipe import if the underlying service is discontinued.

10.3 Effect of Termination

Upon termination, your right to use the Service immediately ceases. Provisions of these Terms that by their nature should survive termination (including Sections 5, 7, 11, 12, and 13) shall survive.

11. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free.
• Any recipes, nutritional information, or other content provided through the Service is accurate, complete, or suitable for your dietary needs or medical conditions.
• Any errors in the Service will be corrected.

Because your recipes and content are stored only on your device and nowhere else, we are not responsible for any loss of your data resulting from device loss, damage, factory reset, or uninstalling the app. We strongly recommend using the Export feature regularly to keep your own backup.

For UK users: Nothing in these Terms excludes or limits any statutory rights you have as a consumer that cannot be excluded or limited under applicable UK law, including rights under the Consumer Rights Act 2015.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DAMSON KITCHEN AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) £50 / $50 (WHICHEVER CURRENCY IS APPLICABLE TO YOUR JURISDICTION).

For UK users: Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.

13. Governing Law and Disputes

13.1 Governing Law

Damson Kitchen is operated from the United Kingdom, and these Terms are governed by the laws of England and Wales. We both submit to the non-exclusive jurisdiction of the courts of England and Wales.

13.2 Your Rights as a Consumer

Nothing in these Terms takes away rights you have under the consumer-protection law of the country you live in. If you are a consumer resident outside England and Wales, you keep the benefit of any mandatory protections available to you there, and you may bring proceedings in the courts of your own country. We do not ask you to give up any right to bring or join a claim, and there is no compulsory arbitration.

13.3 Informal Resolution

Before initiating any formal dispute, you agree to contact us at hello@damsonkitchen.com and attempt to resolve the matter informally for at least 30 days. Most concerns can be resolved quickly this way.

14. Changes to These Terms

We may modify these Terms at any time. When we make material changes, we will post a notice on this website and within the app at least 14 days before the changes take effect. If you continue to use the Service after the effective date, you accept the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.

15. General

• Entire agreement: These Terms and our Privacy Policy constitute the entire agreement between you and Damson Kitchen regarding the Service and supersede any prior agreements.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
• Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
• Assignment: You may not assign or transfer your rights or obligations under these Terms. We may freely assign our rights and obligations.
• Language: These Terms are written in English. If translated, the English version shall prevail in the event of any conflict.
